2.3 Notice Requirements
Your notice must be in writing and include all the information specified above. Incomplete notices may not be processed. Please note that submitting a false claim may result in legal consequences.
3. Our Response to DMCA Notices
3.1 Review Process
Upon receiving a valid DMCA notice, we will:
- Review the notice for completeness and validity
- Identify and locate the allegedly infringing material
- Assess whether the material appears to infringe copyright
- Take appropriate action based on our findings
3.2 Actions We May Take
If we determine that the material likely infringes copyright, we may:
- Remove or disable access to the infringing material
- Notify the user who posted the material
- Provide the user with information about filing a counter-notification
- Document the action taken for our records
3.3 Response Timeline
We will respond to valid DMCA notices within a reasonable timeframe, typically within 24-48 hours of receipt. However, the exact timeline may vary depending on the complexity of the case and our workload.
4. Counter-Notification
4.1 Filing a Counter-Notification
If you believe that your content was removed in error, you may file a counter-notification. Your counter-notification must include:
- Physical or electronic signature of the content owner
- Identification of the material that was removed or disabled
- Statement under penalty of perjury that you have a good faith belief the material was removed by mistake
- Consent to local federal court jurisdiction
- Contact information including address, telephone number, and email address
4.2 Counter-Notification Process
Upon receiving a valid counter-notification, we will:
- Review the counter-notification for completeness
- Notify the original complainant of the counter-notification
- Restore the material within 10-14 business days unless we receive notice of legal action
- Document the action taken for our records
4.3 Legal Action
If the original complainant files a lawsuit seeking a court order to prevent the restoration of the material, we will maintain the material as removed until the legal dispute is resolved.
5. Repeat Infringers
We maintain a policy of terminating accounts of users who are repeat infringers. A user may be considered a repeat infringer if:
- They have multiple valid DMCA notices filed against their content
- They consistently post infringing material
- They fail to respond appropriately to copyright concerns
We will provide users with appropriate warnings before terminating their accounts for repeat infringement.
6. Fair Use and Other Defenses
We recognize that not all uses of copyrighted material constitute infringement. Users may have valid defenses including:
- Fair use: Limited use for purposes such as criticism, comment, news reporting, teaching, scholarship, or research
- Licensed use: Use authorized by the copyright owner
- Public domain: Material that is no longer protected by copyright
- Original creation: Material created by the user themselves
If you believe your use falls under one of these categories, please include this information in your counter-notification.
7. False Claims
Submitting false copyright infringement claims may result in legal consequences, including liability for damages. If you knowingly misrepresent that material is infringing, you may be liable for damages including costs and attorneys' fees.
8. International Considerations
While this policy is based on U.S. law (DMCA), we respect copyright laws in other jurisdictions. If you are located outside the United States, please ensure your notice complies with the copyright laws of your jurisdiction.
